Florida’s 6-week abortion ban is set to take effect May 1 after the state’s supreme court issued a pro-life ruling.
The Florida Supreme Court upheld the state’s 15-week ban on abortion, prompting the trigger law to take effect next month.
In an April 1 majority opinion, the justices wrote, “Based on our analysis finding no clear right to abortion embodied within the Privacy Clause, Planned Parenthood cannot overcome the presumption of constitutionality and is unable to demonstrate beyond a reasonable doubt that the 15-week ban is unconstitutional.”
As a result of the ruling, the opinion noted, the “six-week ban will take effect in thirty days,” or May 1.
The justices also approved a ballot measure legalizing abortions, allowing voters the choice to keep or remove the ban. “That the proposed amendment’s principal goal and chief purpose is to limit government interference with abortion is plainly stated in terms that clearly and unambiguously reflect the text of the proposed amendment. And the broad sweep of this proposed amendment is obvious in the language of the summary,” they wrote. “Denying this requires a flight from reality.”
President Joe Biden issued a statement on the Florida Supreme Court’s “extreme decision.”
“Yesterday’s extreme decision puts desperately needed medical care even further out of reach for millions of women in Florida and across the South. The Court not only upheld Florida’s current ban on women being able to make their own reproductive choices, it will likely trigger Governor DeSantis’ even more extreme law that would prevent women from accessing care before many even know they are pregnant. It is outrageous,” the statement read.
Biden claimed the abortion bans put the “health and lives of millions of women at risk.”
“These extreme laws take away women’s freedom to make their own health care decisions and threaten physicians with jail time simply for providing the medical care that they were trained to provide,” the statement continued.
In a statement shared on X, Biden wrote, “Yesterday, Florida’s Supreme Court upheld a state abortion ban, likely triggering the Governor’s more extreme law eliminating access before many even know they’re pregnant.”
“Outrageous,” he asserted, adding that he and Vice President Kamala Harris “remain committed to protecting reproductive freedom in Florida and across the U.S.”
